§ 1. General Information

  1. The operator of the PIXERSIZE's website is PIXERS LTD.
  2. All relations under the Agreement between PIXERS LTD (Offerer") and its Customer are the subject to general commercial terms and conditions. Any possible exemptions shall be considered only if previously confirmed between PIXERS LTD and the Customer in writing or if explicitly specified in these general commercial terms and conditions. Any oral commitments of the Offerer.

§ 3. Limitation of Liability

  1. Bearing in mind the present state of technology we cannot ensure a faultless and always available internet-based communication. We shall not bear any liability for a constant access to our online system, as well as for any technical or electronic errors which may occur whilst shopping, on which we have no influence, especially for the ones delaying processing or accepting orders.

In matters not covered by the Term of Use shall apply the provisions of the Civil Code, the Law on the specific terms of consumer sales, the Act on Competition and Consumer Protection and the Law on the protection of certain consumer rights and liability for damage caused by a dangerous product or other laws applicable to the activities and operations of an online store, in accordance with international law.
  2. Offerer reserves the right to substitute the Terms of Use without prior approval by the Customer.

Terms of Sale

§ 1. Concluding the Agreement

  1. The operator of the PIXERSIZE's website is PIXERS LTD.
  2. Images and other products presented by PIXERS LTD in the internet or in other media are not an offer of sale, but merely an invitation to submit customer bids (invitatio ad offerendum). Requests can be submitted online via order forms prepared by PIXERS LTD.
  3. The products offered are just model motives. Therefore, the Customer does not receive the original image, but a digital copy consistent with the motif displayed on the website.
  4. Every ordered service must be customized by the customer according to her/his wishes. Please familiarize yourself with all the possibilities of customization and take into consideration the final price. All prices are always gross.
  5. The agreement is not separately stored by PIXERS LTD. Data relating to the contract shall be made available to the customer on the confirmation received electronically. The current terms and conditions are available at http://pixersize.com.
  6. Orders placed by the customer are accepted taking into account the current conditions and prices. To make the invoice we take into consideration only the price valid at the moment of the order. All prices are gross prices.
  7. Together with changes on PIXERS LTD websites all stated prices and other information regarding the services expire.
  8. The offer is available only for a limited period of time and in a limited quantity. In the event the limit of the offer or period of time is exceeded, one may not lay claim the right to delivery.

§ 2. Payments

  1. Payments for the services may be made in the form of a pre-payment by a credit card, a transfer to the indicated bank account or via the PayPal system.
  2. Payment by cheque or cash is not possible.
  3. We shall not bear any liability for any cash payments.
  4. PIXERS LTD. reserves the right to accept or refuse certain forms of payment in individual cases.

§ 3. Service Delivery

  1. The service is provided only while stocks last. Where service delivery is not possible, PIXERS LTD undertakes to immediately notify this fact to the customer. If the customer has paid for the service, its value will be returned immediately.
  2. For each service an approximate time of the service is given, and it elapses from the moment of receiving the full payment for the service by PIXERS LTD. Some services may be implemented individually.
  3. Shipping of services printed by PIXERS LTD follows as it was selected by the customer. If the customer require a special type of shipment other than available at PIXERS, it will be related to higher shipping costs, which the customer is obliged to cover. Packaging and shipping costs are different in every country and are valid only on the mainland. In case of islands there are some additional fees, which shall be covered in advance.
  4. Transport packaging and all other types of packaging shall not be returned, according to the guidelines concerning the packaging. The Party agrees to dispose the packaging appropriately on its own cost.
  5. The lump shipment costs are calculated for each of the products ordered in accordance with the price list available on http://pixersize.com website.
  6. In case of shipment abroad to a country not being a member state of the EU, the recipient agrees to cover all the customs duties applicable in a given country, including customs control duties.
  7. In case of a delivery which fails to comply with the Agreement resulting from the fault of our company, the Customer agrees to grant the Company an additional 2-week delivery deadline for the products ordered. In other cases, the Customer shall not be entitled to withdraw from the Agreement.
  8. Personal receipt of the service is not possible.

§ 4. Damages caused while Shipping

  1. If the product is delivered to the customer with visible defects, it must be immediately reported the PIXERS LTD (contact@pixersize.com)
  2. In case of revealing hidden defects, please inform PIXERS LTD immediately.
  3. Statutory shortening the dates concerning the limitation of lodging complaints is not connected with these provisions.

§ 5. Right to withdraw from the Terms of the Agreement

  1. Customer has the right to withdraw from the contract without giving any reason within 365 days counted from the date of the agreement. Printing service from PIXERS LTD returned in this mode shall be delivered in full without any damage, and no signs of usage. Returned service or returned printing service can not be earlier copied, reproduced and made ​​public.
  2. Printing service should be returned to any courier at their own expense to the address indicated by PIXERS LTD.

§ 6. Returns Rights

  1. Buyer has the right to return the printing service only in case of non-compliance with the agreement within 365 days from the date of its delivery.

PIXERS LTD warns that in case of prining services purchased on canvas, posters, wall murals, there may be slight deviations of colors compared to the offered motives, as well as deviations resulting from different size, paper quality, material and surface.
  4. Printing services offered by PIXERS LTD are managed with programs accessible for the public.
  5. If PIXERS LTD will provide a defects-free supplement for the realized service, it may be required returning the defective service from the customer.
  6. Damage caused by incorrect activities of the customer and activities inconsistent with the agreement are not the basis for filing claims against PIXERS LTD.

§ 7. Retention

  1. Delivered service remains the property of PIXERS LTD until receiving the full payment for the service.
  2. At a time when the customer sells service owned by PIXERS LTD, she/he undertakes to take over responsibility for claims arising from claims of ownership.
  3. Customer agrees to report immediately any attempt to take over services PIXERS LTD owned by third parties.
  4. Every pledge, transfer of ownership, etc. of the service owned by the company is possible with a prior consent by PIXERS LTD.

§ 8. Withdrawal

  2. Regardless of the claims of PIXERS LTD, in case of the partial withdrawal from the hitherto realized services, they must be billed and paid in accordance with the actual situation on the day of withdrawal.

§ 9. TETREES warranty

  1. This warranty applies to the usage of TETREES modular furniture system at home and in office, in accordance with the instructions of use, and covers defects and/or malfunctions in material and/or workmanship.
  2. TETREES undertakes to execute orders in accordance with the details of their submissions.
  3. TETREES gives the warranty for the period of 24 months for purchased goods in case of manufacturer's defects. This guarantee is valid from date of purchase.
  4. Upon receipt of shipment Customer shall check the condition of the purchased furniture.
  5. The period for claims on furniture designed for assembly and delivered in packages (if only the package shows no signs of damage) is 7 days from date of purchase. It covers visible (overt) workmanship defects and/or lack of defelements (accessories).
  6. The exchange of goods for new items free from defects results with an extention of the warranty for the next 24 months.
  7. The warranty shall not be entitled in case of improper usage of furniture, inconsistent with its intended purpose, and in case of any repairs or alterations made on the supplied furniture by the Customer.
  8. The warranty does not cover faults, defects and damages resulting from accidental, mechanical damage, improper operation or maintenance, unauthorized repairs or modifications and design changes made by the Customer. The Manufacturer does not recognize for defects any derogations in color and wood, which are natural features of the material or are the result of the technological process.
  9. The warranty covers the following elements of the TETREES modular furniture system:
    - Cabinets Enclosures
    - Fronts - Furniture Fittings
    - Shelves
  10. The Manufacturer is obligated to consider any complaint within 14 days, and, if it was not possible, to inform the Customer of the time when the compalint would be considered.
  11. The Customer whose complaint is justified can demand: to remove defects of furniture by the manufacturer, or to receive the new furniture free of defects.
